These Terms of Service govern your use of BC Cloud services. Please read them carefully. By using our services, you agree to be bound by these terms.
This agreement ("Agreement") is between BC Cloud ("BC Cloud", "we", "us", "our") and you ("Customer", "you", "your"). It sets out the terms and conditions governing your use of all BC Cloud products and services, including VPS hosting, game server hosting, web hosting, app hosting, monitoring, managed services, and network controller hosting (collectively, "Services").
By signing up for or using any BC Cloud service, you confirm that you have read, understood, and agree to be bound by this Agreement, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, all of which are incorporated by reference.
If you do not agree to these terms, you must not use our services.
By registering for BC Cloud services, you confirm that:
It is your responsibility to keep your account information up to date, including a valid email address. BC Cloud is not responsible for service disruptions caused by outdated contact details.
You are responsible for maintaining the security of your account credentials. Notify us immediately at support@bccloud.co.uk if you suspect unauthorised access to your account.
BC Cloud will use reasonable endeavours to ensure Services are available 99.9% of the time in any given calendar month, excluding scheduled maintenance. We will provide reasonable advance notice of planned maintenance windows via email or our status page.

Services are billed on a recurring monthly basis. By providing your payment details, you authorise BC Cloud to charge your payment method on each renewal date until you cancel your service.
Invoices are generated on or around your renewal date. It is your responsibility to ensure your payment method is valid and has sufficient funds. Invoices must be paid by the due date.
Prices displayed may be exclusive of VAT. Where applicable, UK VAT will be added to your invoice. If you are a VAT-registered business, please provide your VAT number in your account settings.
Services not paid within 7 days of the due date may be suspended. Services suspended for more than 14 days may be permanently terminated and all data deleted. BC Cloud is not liable for data loss resulting from suspension or termination due to non-payment.
We reserve the right to change our pricing. We will provide at least 30 days' notice of any price increase, giving you the opportunity to cancel before the new price takes effect.
You may cancel any service at any time through the client area or by submitting a support ticket. Cancellations take effect at the end of the current billing period unless you request immediate cancellation.
Upon cancellation, your service will remain active until the end of the paid period. After that, all associated data will be permanently deleted. BC Cloud does not retain data after account closure.
BC Cloud reserves the right to cancel or suspend any service immediately, without refund, in the event of a breach of this Agreement or our Acceptable Use Policy.
You retain ownership of all content and data you store on BC Cloud services ("Your Content"). You are solely responsible for Your Content, including ensuring it is lawful and does not infringe the rights of any third party.
BC Cloud does not routinely monitor the content of customer services. However, we reserve the right to review and take action on content that is reported to us or that comes to our attention in breach of this Agreement or our AUP.
Backups: BC Cloud may offer automated backup features as part of certain plans. However, you remain solely responsible for maintaining your own backups. BC Cloud does not guarantee the recovery of lost data. We strongly recommend maintaining independent backups of all critical data.
Your use of BC Cloud services is subject to our Acceptable Use Policy, which forms part of this Agreement. You agree to comply with the AUP at all times.
Breach of the AUP may result in immediate suspension or termination of your services without refund and, where appropriate, reporting to law enforcement authorities.
All intellectual property rights in the BC Cloud platform, website, branding, and documentation belong to BC Cloud or its licensors. You may not copy, modify, distribute, or create derivative works from any BC Cloud content without express written permission.
You grant BC Cloud a limited, non-exclusive licence to use Your Content solely to the extent necessary to provide the Services to you.
To the fullest extent permitted by applicable law, BC Cloud's total liability to you under or in connection with this Agreement shall not exceed the amount you have paid to BC Cloud in the three months preceding the event giving rise to the claim.
BC Cloud shall not be liable for:
Nothing in this Agreement limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Each party agrees to keep confidential any information disclosed by the other party that is marked as confidential or that a reasonable person would consider confidential given the nature of the information and circumstances of disclosure.
This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law or regulation.
BC Cloud may update these Terms of Service from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of our services after the effective date constitutes acceptance of the updated terms.
If you do not agree to the updated terms, you may cancel your services before they take effect.
This Agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction.
